族群平等委員會代我向英國方代辦求償的一封信


透過英國華裔朋友的轉介,我到了一個位在倫敦Baking的一個非營利組織,叫做「族群平等促進委員會」(Barking & Dagenham Racial Equality Council),他們聽了我的遭遇後,為我寫了一封信向代辦機構的最高層級求償。以下你可以看到完整的原始信件:


這封信讓我發現一個曾經擔任市議員的英國白人是怎麼看待我們這些海外移民的,不僅使我明白了原來在當地居民的眼中我們的處境是如何劣勢,也讓我明白原來過去很多好不容易懇求到代辦願意見我一面的協商根本不應該是那樣發生、那樣進行的雙方的地位是有多麼地不平等更別提我和這位執筆者的英文能力的區別導致信件正式度、措辭強烈感受度的落差了。

這封信也是讓曾經擔任過這個計畫的志工和讀者了解,我不僅嘗試過向負責我個案的主管解釋了,我也並不是沒有試著向CXX最高主管申訴過我的案件(沒錯,就是志工朋友你那包CXX pack裡的投訴管道聯絡方式)。我們寄送信件的對象正是CXX的CEO。


對於錢,我其實覺得那根本已經不重要了,我已經當作是放水流去了,但是後來,就像一些朋友跟我說的,屬於自己的權利就是屬於自己的,我覺得還是要試著爭取看看,盡力去做做看,也是為了給以後可能遇到同樣遭遇的志工一個可以參考的經驗,至少讓他們知道我有試過,但是代辦可以給你的回覆就是這樣!(在這之前我已經諮詢過市民諮詢委員會了,根據他們在法律上的看法,應該是沒有什麼機會可以跟代辦拿回什麼錢的,因為我是把錢交給台灣的代辦,所以沒辦法跟英國代辦要求有第二份工作或甚至是英國方的賠款。(其實志工也沒有證據可以顯示英國方有拿到錢)。)

為了幫助可能閱讀英文比較不方便的朋友,我摘要一些信裡的重點:

1. 他們認為,我才剛進入這個計畫工作沒多久,而且,志工又是付了那麼一大筆錢才能加入計畫的,照理說,代辦應該要給予協助,而不是迅速地將一個志工逐出。

2. 他們認為,不論是在8/24或是9/5的會談,我都沒有任何人陪同,根本沒有人來協助表明、論述與堅持我這一方的觀點,但是,我明明才剛到這個國家沒多久,英語也說得不好,這很顯然違反了公平正義原則。

3. 他們認為我實際上就是在一個陌生的、話又說得不好的國家被迫無家可歸、流離失所。失去了很珍惜的志工工作,我很沮喪;我受到很大的驚嚇、感覺被遺棄,因為我從來沒有機會能夠正確完整地的解釋我這一方的事實,而這並不公平。

4. 我們委員會很擔心其他的志工也在同樣的處境當中,因為他們都是從別的國家來的,而且通常都是第一次來到這個國家,如果他們被你們驅逐,但又沒有辦法獲得你們後續的援助,他們是特別容易受到傷害的一群人。

我覺得第二點真正指出了讓我很震撼的一項事實,不僅道出了我人在英國時英國方代辦和我的權力地位有多麼不平等,也很切要地指出了台灣方代辦回應我時的舉例所透露出他們的觀點和心態:如果一個外勞在台灣工作時發生勞資糾紛,那因為雇主是唯一和外勞有接觸的人,所以法官當然很合理地是採用雇主的證詞。

在這封信裡你也看得到委員會認為代辦應該賠償我多少錢。英國代辦曾經回了一封信,說他們會展開調查,並在一個星期內回覆我們,但時至今日,從來都沒有下文。反正我都已經離開英國了。(另一方面,我認為對於委員會來說,因為我處境是平安的,也沒有其他重他傷害,相對於他們正在處裡的其他案子是比較不緊急的(其他多數是種族歧視的人身攻擊事件),所以就比較不會積極去爭取聯絡;但若是我當時的選項是爭取要另一個志工工作,我相信是辦得到的,所以還是建議在當地的志工要在第一時間善用資源。)

Dear Ms Caxxxr,

Re:  Chun-Tzu Huang

I have been contacted by Ms Huang with regard to her dismissal from the CXX programme.  We wish to raise the following issues with you on Ms Huang’s behalf.

1.Ms Huang strongly disputes the reasons given for her dismissal.  She was also new to  
   your Programme and it would seem to have been reasonable for the organisation to have
   given her help and support rather than to dismiss her so quickly especially as she had to
   pay a considerable sum of money to get on your programme.

2.When called to a meeting on 24th August there were 3 managers present and Ms Huang
    was not given the opportunity to have anyone to accompany her to what appears to have
    been almost a disciplinary meeting.  Also on the meeting on the 5th September when she
    was dismissed she also did not have the opportunity to bring someone to help and support
    her to make her case which appears to be against natural justice considering she had not
    been in this country very long and has imperfect English language skills.

3.Ms Huang had to pay £2000 in order to get on to your programme.  She was expecting to
   work as a volunteer for you for a period of one year.  However she has only had the
   opportunity to volunteer with you for just over one month.  She therefore is requesting you
   refund her at least eleven twelfths of the money she paid since she has only benefitted
   from eleven twelfths of the experience she paid for.

4.Ms. Huang was entitled to a payment of £75 per week which was stopped at the end of
   August and she has not received any money since so has had to fund herself until she has
   been able to organise a return ticket home.  Ms. Huang is asking to be reimbursed for the
   period between 1st and 5th September and also, in our opinion, she should receive
   equivalent  money towards her expenses whilst awaiting her return home, especially as
   she has had to find accommodation.

5. Under the agreement your organisation has with volunteers, we understand you are
    contracted to pay their expenses between their place of residence and the airport.

6. This whole experience has been very traumatic for Ms Huang who was left effectively
    homeless in a strange country whose language she speaks imperfectly and very distressed
because she had lost her voluntary work which she valued so much and she also felt frightened, abandoned and that she had been treated most unfairly as she did not feel she had the opportunity to have her side of things properly explained and listened to.

Ms. Huang is concerned that other volunteers from abroad may in future also experience a similar situation,  and we share that concern, especially as it appears many of your volunteers are from other countries and in this country for the first time, and are therefore particularly vulnerable if they are dismissed and without formal continuing support from you.

We attach for your perusal a schedule of loss in regard to Ms. Huang’s time with your organisation and your dismissal or her and refusal to find her alternative voluntary work.  We also attach a copy of Ms. Huang’s authorisation for disclosure.  We look forward to hearing from you.
